General Terms and Conditions of Service
These Terms and Conditions (the "Agreement") constitute a legally binding agreement between GOOD WAY TRANSPORT INC (hereinafter referred to as the "Company") and any natural or legal person accessing our website or utilizing our logistics services (the "Client").
1. Scope of Operations
The Company operates as a logistics provider and freight forwarder. All services provided, including road transport, cargo handling, and warehousing, are governed by these Terms and, where applicable, by the provisions of the Carriage of Goods by Road Act and international conventions (such as CMR or similar).
2. Accuracy of Consignment Data
The Client warrants that all descriptions, values, and technical data regarding the cargo provided to the Company are accurate and complete. The Client shall be held liable for any damages, fines, or extra costs incurred by the Company due to inaccurate weight, hazardous material declarations, or insufficient packaging.
3. Payment and Financial Obligations
All invoices issued by GOOD WAY TRANSPORT INC are due upon receipt unless otherwise agreed in writing. Late payments shall accrue interest at the maximum rate permitted by law. The Company shall have a general lien on all goods and documents in its possession for all sums due from the Client.
4. Limitation of Liability and Force Majeure
The Company shall not be liable for loss or damage to goods caused by circumstances beyond its reasonable control, including but not limited to: acts of God, extreme weather conditions, strikes, civil unrest, cyber-attacks, or governmental actions (Force Majeure).
In cases of proven negligence, the Company's liability is strictly limited to the declared value of the goods or the limits established by the standard conditions of the logistics industry, whichever is lower.
5. Claims and Notifications
Any claims for loss, damage, or delay must be submitted in writing within 48 hours of delivery. Failure to provide such notice shall constitute prima facie evidence of delivery in good condition.
